THE STEPS

Writing Like a Storyteller

STEP 1
Lean on details instead of characterizations— whenever possible.
STEP 2
Lean on specifics instead of vague or ambiguous words (unless you have a reason to stay cursory).

DETAILS OVER CHARACTERIZATIONS

Use details—not characterizations

Look at the difference it makes when you rely on characterizations (first example) instead of focusing on choice details (second example). Which do you find more persuasive?
“The string of harassment continued incessantly during the entire filing period. The harassment grew worse and worse.”
“Watson’s supervisor ridiculed her daily, calling her names like a ‘witch.’ By the third month, Watson was enduring these ridicule several times a day—whether in a group status meeting or when she was alone at her station.”

DETAILS OVER CHARACTERIZATIONS

Use details—not characterizations

Let’s see the same technique at work, this time in a different example.
“Defendant has extensively litigated this case, spending countless hours and resources throughout the process. It is thus entitled to additional fees."
“Defendant has spent hundreds of hours working on this case. Its attorneys have come up with no less than six novel legal theories, ranging from supposed jurisdictional failures to multiple alleged problems with the complaint’s allegations about fraud...”

WORKSHOP TOPICS

See what’s covered in Writing About the Facts I & II

The facts are just as important as the law—and sometimes even more important. Even the most stale legal issue is hiding a story within. Whether it’s a story about a rule, the factual story underpinning a dispute, or a story about the parties—great legal writers must be great storytellers. These workshops will explore several concrete storytelling techniques used by the best legal writers in the world.
